Power Washing A Deck Successfully


Power washing a wood deck obviously isn’t rocket science. But without some caution, the cleaner can easily cause more damage then imaginable.

The truth of the matter is that pressure washers were never really intended for use on wood surfaces. These high pressure machines are really designed for hard surfaces so the operator has to take great care when using on a deck. I know the guy at the rental company or the sales man at the local home store said cleaning a deck is a cinch, but actually it is much easier to become a “wood engraver” then you might think. I know what I’m talking about after having to attempt to correct the workmanship of many DIY’ers over the years.images (3)

So please accept this warning so you don’t have to rent a floor sander next weekend to remove the traces of your cleaning effort. You will never need a machine capable of producing more than 1500 pounds per inch water pressure. Even at this power, it is very easy to damage your deck

Be sure to wear old clothes and safety glasses. You are going to get wet and you will get sprayed with the cleaning solution regardless of how careful you are. In many positions on your deck surface, such as in corners, the spray has no where to go except right in your face.

Having said that, pressure washing a deck can produce excellent results if you take your time and use the machine in the proper way. The first step is setting up your machine. You attach a 3/4 inch water hose to your machine. Now attach the high pressure hose with the spray wand. At this point, turn you water on. Do not attempt to start your machine until the water is connected since this can do damage to the pump section of your machine.

When starting many gas powered machines you might find it easier to start if you squeeze the trigger until the water flows through your machine. Take a few minutes and be sure your overspray will not damage any plants or outdoor furniture, etc. To prevent any damage from your cleaning solution, just cover with waterproof tarps at this point. Just remember, all that water and cleaning solution has to go somewhere. You don’t want to go out the next morning to find spotted plants or house siding.

The secret to cleaning decks is to let your cleaning solution do most of the work. Away from the deck, preferable on a driveway or hard surface walk, use your machine to get used to the power. Open the spray head to a wide spray or “fan” pattern since this is what you will use 99% of your time. You are going to use that “fan” spray to rinse off your cleaning solution. Even in this position, the spray will remove embedded dirt with little effort.

There are literally dozens of deck cleaners on the market today. Some are simple detergents, while others contain bleaches and specific chemicals which react with certain wood types. I would strongly suggest against using household bleach. Stick with the commercial deck cleaning products to minimize the danger to your surrounding areas and plantings. Many of the larger deck stain manufacturers have their own deck cleaning products. Which ever product you chose, be sure to read and follow the manufacturer’s instructions. You will find that most instructions will not include any directions or suggestions of using a pressure washer. They are well aware of the dangers I mention above.

Unlock Your UK Pension Abroad – Introducing Qualifying Recognised Overseas Pension Schemes (QROPS)


It’s always a little sad when one has to start worrying about pensions.

Expats are no different to most people in that the word ‘pensions’ reminds us that aging is inexorable and that we need to think about making some sort of provision for that period in our lives when work may be a thing of the past.

For expats there are always added complexities. Will the pension be payable locally? Will it be taxed back in the old country? What are the currency issues? How will legislation ‘back home’ affect me if I’m living overseas?

This is a vast and complicated area and this is the first in a short series of articles that will examine one particular aspect of the pensions maze – QROPS. This slightly scary acronym stands for Qualifying Recognised Overseas Pensions Scheme and relates to how expats can move their pensions out of the UK to their new country of residence.

Before we get into the intricacies of this, let’s first think about some basic definitions and facts.

Pensions are complicated!

One of the characteristics of articles on pensions is that any ‘what is best for me?’ type questions can’t be answered simply. What you as a reader should do with/about your pension scheme to maximise your benefits and reduce your risks is something that can only be decided once an expert has discussed with you your individual specific circumstances and made some evaluations based upon understanding those in-depth.

You should never make decisions about what to do with your pension based upon any general article, including this one. In a sense this is a disclaimer – always consult an expert to make sure you know you’re doing the right thing.

What is a pension?

No single article can describe the complexities in full of the UK’s pension system.

In this article we’ll consider simply that a pension is a financial provision (policy, investment, employer’s scheme etc) that you contribute to over your working life so as to provide you with regular income from your retirement onwards. They will be governed by legislation that restricts what you as ‘the saver’ can do with the funds accumulated before retirement age and in theory, what the person holding your pension funds can do with them.

Types of pension

There are vast numbers of schemes policies and financial instruments that all qualify as ‘pension schemes’ and they will have different characteristics. For the purposes of this article, we’ll consider that all of them come under one of four headings;

- State pension
- Private pensions schemes
- Occupational pension schemes
- Estate & Related Pensions

At the outset we can discount here ‘estate’ and special arrangement type pensions. These are rare and usually include things such as sums paid regularly after retirement age from a family estate scheme or trustee fund etc. These tend to be highly specialist areas and if you are in receipt of such you most certainly will need advice on what’s best for you if you’re thinking about how expat status may affect them.

The state pension is something that most UK citizens will be familiar with. Basically it works quite simply – as an employee amounts are deducted automatically from your salary and invested by the government. If you’re self-employed you equally simply make mandatory pensions contribution payments to the social services organisation. There are schemes for both employees and the self-employed to ‘top-up’ their contributions if they wish to secure a higher payment at retirement age.

At retirement age, and presuming you have made sufficient contributions over time, you will be paid a state pension each month.

QROPS has no effect on these state pensions or the estate type pension payments.

Occupational pensions schemes allow employers to take and make contributions on behalf of their employees and invest this into pension schemes. At retirement age the company will pay its retirees an annual pension. These schemes are sometimes referred to as ‘company pensions’.

For many years people have also been able to save for their pension by investing in private pension schemes. Sometimes they have been able to fund this by ‘opting out’ of some components of the state scheme and/or their occupational pensions schemes. These private pension schemes also offer regular income payments upon retirement.

It is within these two categories of private and occupational pensions that QROPS has its effects. For convenience from this point onwards we’ll refer to these collectively as non-state pensions.

For many years the non-state schemes were effectively ‘locked’ with the contributor being able to do little or nothing with the funds that had accumulated there. This was a particular challenge for expats who, for many reasons, would have preferred to move their pension fund(s) overseas with them easily and without trauma.

It is worth making clear at this point that there is an important difference between an expat receiving their pension payments overseas and moving their pension or pension fund overseas. It has always been possible and relatively easy to get a UK state or non-state pension paid to you overseas even if sometimes through a UK bank as intermediary. Moving your pension overseas is different and involves shifting the accumulated savings and funds out of the UK to a new company or institution overseas who will then have responsibility for paying you your pension at retirement age.

The political & economic objectives of pension schemes

It’s not unusual to find people, expats or otherwise, who struggle to understand why they can’t access their pension funds as they wish. If you have 30 years worth of accumulated savings in the UK in your various pensions, why can’t you take 25% of it out to fund that new house extension? You know that locally to you in your new country there is a bank that offers apparently superb pensions schemes, so why can’t you just transfer all your UK pension savings into the new local scheme?

Some countries believe that the state has an obligation to look after its citizens and should not allow them to get themselves into a position whereby they become destitute at retirement – an age where most will be unable to recover their financial position. It’s also true that the state does not wish to be left with lots of pensioners to support who have no income via savings in either state or private pensions.

In these countries, and the UK is one such, the state insists that all people contribute some of their earnings through life into a pension scheme to provide for their old age. As such, governments cannot allow unrestricted access to these funds without putting at risk this objective.

Over recent years however, the EU has recognised that we live in an increasingly global and mobile world. The EU was keen to ensure that people are treated equally when making pensions contributions and that they have the right to move their funds where required. Out of this QROPS was born – to provide a facility to allow the transfer of pension funds from the UK to an overseas country and scheme.

QROPS – The principles

QROPS was introduced under UK legislation and practice changes in 2006. Basically it now means that people will be able to transfer their non-state pension funds to an approved overseas scheme.

What this means simply is that if you are living in say Australia and wish to transfer your UK non-state pension fund to a local pension organisation scheme, then you can do so. As a point of technicality, you do not have to be resident in the country you transfer to.

So if you live in Australia you could transfer your on-state pension funds from the UK to New Zealand or France – that would be perfectly acceptable under the scheme.

The key thing to note though is the use of the word ‘approved’ in the above. Any overseas scheme that you wish to transfer your pension to must be approved by Her Majesty’s Revenue & Customs (HMRC).

The ‘approved’ here means that the scheme is legally registered and approved as a pensions scheme in the country concerned, and that it is able to comply with the mandatory reporting requirements of HMRC. A full list of qualifying schemes and companies listed by country is available on the HMRC website.

Retiring Gracefully – Pension Treatment on Divorce


Just eight per cent of divorce settlements fully consider the assets of a spouses pension fund. This article explains how to make pensions count in any divorce settlement.

There are no hard and fast rules regarding your financial rights in the breakdown of a relationship.

There will often be a range of possible solutions to dividing the assets, and it could be that a couple comes to an amicable agreement, with lawyers simply drafted in to formalise the agreement. Unfortunately though, in many cases, courts will be involved in deciding the division of assets.

The financial split can be affected by many factors, including the age of those involved, the length of the relationship, and the needs of each party and any children, and will routinely address income, property and savings.

A pension is often the second most significant capital asset in a marriage and so should be taken into account by a couple and their representatives when arranging a divorce or dissolving a civil partnership.

But pensions can be complex and confusing at the best of times, and are all-too-often glossed over, leaving many people unknowingly with a lot less than they are entitled to. The details must be thoroughly scrutinised by an experienced family law expert and, in some cases, an expert or a pension actuary brought in to help.

Frequently, one person has a substantial pension while the other might have none or a very limited pension provision because, for example, they have given up their job to look after the children.

If we are honest, it is normally the wife who has the lowest – if any – pension provision, as it is assumed during the marriage that she will share in the benefit of the husbands pension income when he retires. The pension is for both of them in effect – until things go wrong.

If the marriage fails, there is no automatic entitlement to a spouses private or occupational pension. In addition, there are rules which allow one divorced spouse to take National Insurance contributions from the other to make up deficiencies in their basic state pension.

After a divorce, it is often the case that the wife has little chance of being able to sufficiently build up a pension of her own during any working life that may be left to her.

There are a number of different roads couples can go down to tackle pension assets depending on their circumstances. These are offsetting, earmarking and pension-sharing.

In this day and age, pension sharing is the preferred route of most divorce courts but offsetting and, to a lesser extent earmarking, are also still valid in some cases. This is why it is vital you discuss your case and unique set of circumstances with an experienced family lawyer. This will give you the best chance of a fair, expedient outcome.

Offsetting involves balancing the pension fund against other matrimonial assets, such as the house. For instance, the wife might cede the pension fund to her husband in return for a larger share or all of the profits from any property.

Anyone considering this route though should think about it very carefully because of the different nature of capital assets and pensions. Pensions are not liquid assets, and, as such, can only be turned into cash on retirement. Their value on retirement could be much higher than at the time of assessment.

With earmarking, the court awards a percentage of the income the other party gets from the pension to the former spouse. This seems fairly straightforward and fair. However, it has numerous disadvantages which is why it has fallen out of favour. For instance, the income stops on the death of the pension holder or if the wife remarries.

The third option, and the one which is the preferred choice in the majority of cases these days, is pension sharing.Pension

Thanks to the Welfare Reform and Pensions Act 1999 (WRPA), UK Pension this allows one party the opportunity to secure a percentage of their spouse’s pension rights and to put that percentage into their own name.

This is preferable in many cases because a person can feel more in control of their own future rather than being dependent on an ex-husband, they can decide when they retire and it can be paid to children or a new spouse if the person dies before they retire.

It is important to note that when a pension is divided or shared, this does not mean that the recipient will receive a cash lump-sum. A pension or part of a pension that is ordered from one party to another still remains a pension and has to be invested in a pension plan.

There are also rules about when a pension can start being paid. For example, in a recent case the husband had two pensions. One was a private pension scheme paying out on the husbands 50th birthday or at any time thereafter, and the other was an occupational scheme which paid out when the husband reached 60. The husband was five years older than the wife. The rules provide that the occupational pension scheme can only be paid out to the wife on her 60th birthday, five years after the husband could begin receiving his pension income.

The negotiations in that case concentrated around the wife taking the entire private pension scheme, which she could start to benefit from at any time after her 50th birthday, and less of the occupational scheme which would only pay out from the wifes 60th birthday.

A pension sharing order cannot take effect during a divorce procedure but is dependent on the Decree Absolute being granted, the final stage of the divorce process. The provider of the pension arrangement will then have four months to put the pension credit into place.

The pension provider must provide the former spouse with information about charges associated with the transfer within 21 days of receiving the pension sharing order to ensure everyone is clear on what fees are associated with making the changes.

Once the provider has completed the necessary calculations and completed the pension credit, a notice of discharge of liability will be issued to both parties. This will show the value of the pension debit and pension credit, the remaining fund value to the pension holder and how the parties have paid the charges.

Anyone not happy with the decision of the court and final settlement for a pension decided during a divorce does have the right to take up the case either at appeal or through the Pension Ombudsman.

One of the most difficult tasks when resolving pensions and how they should be shared is the actual value of a pension fund. This is particularly important when valuing occupational pension schemes, such as those in the armed forces, police service and NHS. There are at least 100 different methods of calculating the value of a pension and to make a comparison fair, it can be necessary to get an expert to value the pension. There are recent cases where a pension fund has been increased by almost a third by getting a proper valuation. When you are talking of pension funds which can be as much as £600,000, like with a GP or senior officer in the armed forces, that is the difference of some £200,000.

Anyone who is involved in a divorce and needs to investigate a claim on a pension fund should not assume that all will be well, they will get treated equally and so pay the process little heed.

Expert advice and guidance from experienced professionals is the only way to ensure you are not left rueing the financial split while getting over the emotional break-up.

The process on considering pensions in a financial settlement should be as follows:

 

  • Find out what pension provision there is.
  • Decide with your lawyer if the amount of the pension and the facts of your case make further investigation justifiable (ie, cost versus benefit).
  • If you wish to push ahead, investigate fully, ideally helped by a specialist IFA or pension actuary.
  • Decide how to adjust the settlement in the light of this knowledge.
